Terms of Service
These Terms of Service ("Terms") govern your access to and use of pickrate.io and the Pickrate services (the "Service"), operated by PurelySearch LLC ("we," "us"). By using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. The Service
Pickrate measures and reports how often AI agents select developer tools across tasks and models ("Pick Rate"), and provides related dashboards, evaluations, and APIs. Public report cards and leaderboards are a measurement, not a statement of fact about any vendor's quality, and are provided for informational purposes.
2. Accounts
You must provide accurate information and keep your credentials secure. You're responsible for activity under your account. You must be at least 16 and able to form a binding contract. Notify us promptly of any unauthorized use.
3. Plans, billing, and credits
- Subscriptions (Pro, Premium) are billed in advance on a recurring basis through Stripe until cancelled. Cancelling stops future renewals; you keep access through the end of the paid period.
- Custom Eval credits are prepaid, one credit per trial, and are consumed as you run evaluations. Except where required by law, fees and credit purchases are non-refundable.
- We may change prices on a prospective basis; changes won't affect the period you've already paid for.
4. Acceptable use
You agree not to:
- Break the law or infringe others' rights using the Service.
- Disrupt, overload, or attempt to gain unauthorized access to the Service or its infrastructure.
- Scrape, resell, or systematically extract the Service or its data except through features or APIs we provide for that purpose.
- Submit content to evaluations that you don't have the right to submit, or that is unlawful or malicious.
5. Your content
You keep ownership of the inputs you submit (prompts, competitor lists, configurations) and the results generated for you. You grant us the limited license needed to operate the Service — to process your inputs (including via our AI model providers) and deliver your results. How we handle that data is described in our Privacy Policy and Trust & Security page.
6. Our intellectual property
The Service, including its software, methodology, and the look and feel of pickrate.io, belongs to PurelySearch LLC. These Terms don't grant you any rights in our trademarks or brand.
7. Third-party services
The Service relies on third-party providers (listed on our Trust & Security page). We're not responsible for those providers' own services, and your use of them may be subject to their terms.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. Pick Rate and related metrics are statistical measurements of model behavior at a point in time; they are not guarantees, and we don't warrant that they are error-free or fit for any particular purpose.
9. Limitation of liability
To the fullest extent permitted by law, PurelySearch LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim.
10. Indemnification
You agree to indemnify and hold PurelySearch LLC harmless from claims arising out of your use of the Service or your violation of these Terms.
11. Termination
You can stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination (such as IP, disclaimers, and limitation of liability) will survive.
12. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The exclusive venue for disputes is the state and federal courts located in Delaware.
13. Changes
We may update these Terms. When we make material changes, we'll revise the effective date and, where appropriate, notify you. Continued use after a change means you accept the updated Terms.
